As the CLARITY Act works its way through the U.S. legislative process, the digital asset industry finds itself watching Washington with a familiar mix of hope and hedging. The bill promises something the crypto sector has wanted for years: a clear, workable framework distinguishing how digital assets are classified and regulated. But what happens if it doesn’t pass, or passes much later than expected? Four industry leaders weighed in on the stakes, the risks, and why a delay may not be the setback many fear.<\/p>\n\n\n\n

A Bill Years in the Making<\/strong><\/p>\n\n\n\n

The CLARITY Act, formally the Digital Asset Market Clarity Act, is the most serious attempt yet by U.S. lawmakers to draw a clean line between which digital assets fall under the Securities and Exchange Commission and which fall under the Commodity Futures Trading Commission. For an industry that has spent the better part of a decade operating under regulation by enforcement, that distinction is not academic.<\/p>\n\n\n\n

The bill has already cleared major hurdles in the House and is now working through the Senate, where amendments and competing priorities could still reshape its final form, or shelve it entirely. None of the founders we spoke to described a doomsday scenario. All of them described a cost.<\/p>\n\n\n\n

Uncertainty, Not Collapse<\/strong><\/p>\n\n\n\n

For Sathvik Vishwanath, Co-Founder & CEO of Unocoin, the outcome matters, but the conversation shouldn’t begin and end with one bill.<\/p>\n\n\n\n

“If the bill does not move forward, the immediate concern would be continued uncertainty around how digital assets, exchanges and other market participants are regulated,” Vishwanath said. “Over time, this could push innovation and capital toward jurisdictions with clearer regulatory frameworks.”<\/p>\n\n\n\n

His broader takeaway centered on intent over process: “What the industry ultimately needs is not regulation for its own sake, but a framework that provides clarity while allowing responsible businesses to innovate.”<\/p>\n\n\n\n

A Delay, Not a Derailment<\/strong><\/p>\n\n\n\n

Mohammed Roshan, Co-founder & CEO of GoSats, framed a possible delay as part of the normal cost of getting complex regulation right.<\/p>\n\n\n\n

“Even if the CLARITY Act does not pass this year, it would not be a setback for the industry, it simply means the timeline shifts. Good regulation takes time to get right, and a short delay is a reasonable price for rules that will shape digital asset markets for years to come,” Roshan said.<\/p>\n\n\n\n

He also argued that patience now could mean durability later. “Clarity will arrive, in the US and eventually in markets like India, and it will be built on a more considered foundation because of the time taken now.”<\/p>\n\n\n\n

The Real Enemy Is Ambiguity<\/strong><\/p>\n\n\n\n

For Punit Agarwal, Founder & CEO of KoinX, the core issue isn’t regulation itself but the lack of predictability crypto businesses operate under across borders.<\/p>\n\n\n\n

“I believe the biggest challenge facing crypto today is not regulation itself, but uncertainty. Crypto is global by nature, while regulatory frameworks continue to evolve differently from one market to another,” Agarwal said. “The CLARITY Act could provide the U.S. with a more defined and predictable framework for digital assets. If implemented effectively, it could give businesses greater confidence to invest, innovate, and build for the long term.”<\/p>\n\n\n\n

Failure to pass, he warned, carries a specific cost: momentum. “If the legislation does not pass, crypto innovation will not come to a standstill. However, the U.S. risks losing momentum as other markets move faster to establish clearer and more structured regulatory frameworks. The industry is not looking for a free pass; it is looking for clear, practical rules that responsible businesses can understand, comply with, and build around.”<\/p>\n\n\n\n

A Reference Point for the World<\/strong><\/p>\n\n\n\n

Edul Patel, CEO of Mudrex, situated the CLARITY Act within a larger institutional shift already underway.<\/p>\n\n\n\n

“For institutions, clarity is less about getting a green light to enter and more about being able to assess legal, compliance and operational risks with confidence,” Patel said.<\/p>\n\n\n\n

Patel drew a direct line to developments in India. “India is already developing its own regulatory approach, with the recent Parliamentary panel recommendations around an interim SRO-based framework showing that the conversation is moving forward domestically. US clarity would not dictate India’s path, but it could provide policymakers with a mature reference architecture.”<\/p>\n\n\n\n

What Comes Next<\/strong><\/p>\n\n\n\n

If the CLARITY Act stalls, the story of crypto regulation does not end there, it simply moves elsewhere. The bigger risk on the table isn’t that crypto stalls without U.S. legislation. It’s that the U.S. cedes its role as the reference point other countries look to when writing their own rules. Every quarter the bill sits in limbo is a quarter in which exchanges, institutions, and regulators elsewhere get to define what “clarity” looks like on their own terms. Crypto has never needed permission to grow. What still hangs in the balance is which country gets to write the rulebook everyone else references next.<\/p>\n\n\n\n
